1. Native Speaker is a foreign languages learning software available as a web online platform.
2. Thank you for using service provided by Europäisches gesunde Figur Institut OÜ. By using the online platform containing interactive Native Speaker (hereinafter referred to as the “Native Speaker"), or by accessing any content or material made available by Europäisches gesunde Figur Institut OÜ (hereinafter referred to as the "Content"), you are entering into a binding contract with Europäisches gesunde Figur Institut OÜ entity indicated at the bottom of this document.
3. Your agreement with us includes these Terms and Conditions of Use (hereinafter referred to as the "Terms").

7. Europäisches gesunde Figur Institut OÜ renders service of granting access to the “Native Speaker” containing “Native Speaker”. Europäisches gesunde Figur Institut OÜ Service requires payment before granting the access. If you cancel your subscription to the “Native Speaker”, or if your subscription to the service is interrupted (e.g., due to changes in your payment details), you may not be able to re-subscribe to the service.
8. Europäisches gesunde Figur Institut OÜ Service is available according to current offers as one time payment. Billing type, prices and term are defined in each offer and are summarized prior to the end of the order process.
9. The “Native Speaker” as well as the Content therein are the property of Europäisches gesunde Figur Institut OÜ and the licensors of Europäisches gesunde Figur Institut OÜ. We grant you with a limited, non-exclusive, revocable licence to make use of the “Native Speaker”, and a limited, non-exclusive, revocable licence to make personal, non-commercial use of the Content. The Licence shall remain valid until and unless terminated by you or Europäisches gesunde Figur Institut OÜ. You hereby undertake and agree to use the Content for your own personal, non-commercial purposes, and that you will not redistribute or provide access to the “Native Speaker” or the Content to any other entity.
10. The “Native Speaker” and the Content are licensed, not sold, to you, and Europäisches gesunde Figur Institut OÜ and its licensors retain ownership of all copies of the “Native Speaker” and the Content even after installation on your personal computers, mobile handsets, tablets, and/or other relevant devices (hereinafter referred to as the “Devices”).
11. All Europäisches gesunde Figur Institut OÜ trademarks, service marks, trade names, logos, domain names, and any other features of the Europäisches gesunde Figur Institut OÜ brand (hereinafter referred to as the “Europäisches gesunde Figur Institut OÜ Brand Features”) are the sole property of Europäisches gesunde Figur Institut OÜ or its licensors. The Agreements do not grant you any rights to use any Europäisches gesunde Figur Institut OÜ Brand Features whether for commercial or non-commercial purposes.
12. We will make reasonable efforts to respond to all Customer Service Queries within a reasonable period of time.
13. The access to the “Native Speaker” can be purchased. By registering to use the paid “Native Speaker”, you agree to gain access to the “Native Speaker” immediately. You may change your mind for any or no reason and receive a full refund of all paid fees within thirty (30) days – 30 day money back guarantee.
14. Your payment to Europäisches gesunde Figur Institut OÜ (or to a third party through whom you purchased access to the “Native Speaker”) shall be automatically collected upon finalizing the payment on the sales website of the “Native Speaker”. The process of finalisation involves introducing payment details to the Europäisches gesunde Figur Institut OÜ system by the Client, and then accepting and authorising them by means of special codes, if required by the bank or by payment provider. The service shall be cancelled within a few days from the date of purchase. However, if you cancel your payment or access to the “Native Speaker” and/or terminate it after 30 day money back guarantee is over (where applicable) we will not refund any subscription fees already paid by you.

If you or Europäisches gesunde Figur Institut OÜ terminate the Agreements, you agree that Europäisches gesunde Figur Institut OÜ does not bear any liability or responsibility against you, and it will not return any amount already paid by you, to the maximum extent permitted by applicable law. The provisions of this section will be enforced to the extent permitted by applicable law. You may terminate the Agreements at any time.
17. We always strive to deliver services that meet the highest quality, but you understand and agree that the Europäisches gesunde Figur Institut OÜ Service is provided on an "as is" and "as available" basis, without any express or implied warranties or conditions. Your use of the Europäisches gesunde Figur Institut OÜ Service is at your sole risk. To the maximum extent permitted by applicable law, Europäisches gesunde Figur Institut OÜ makes no representation, warranty or conditions as to satisfactory quality, merchantability, fitness for any particular purpose or non-infringement. As with any purchase of a product or service, in any manner and in any environment, you should use your judgement and exercise caution, if applicable. No advice or information, whether oral or in writing, obtained by you from Europäisches gesunde Figur Institut OÜ shall constitute warranty of any kind from Europäisches gesunde Figur Institut OÜ in this regard. Some aspects may not be valid in some jurisdictions if prohibited by applicable law. However, this does not affect your Statutory Consumer Rights.
18. You hereby agree that to the extent permitted by applicable law, your sole and exclusive remedy for any problem or dissatisfaction with Europäisches gesunde Figur Institut OÜ Service is to uninstall the “Native Speaker” completely, and stop using thereof.
19. To the maximum extent permitted by law, in no event will Europäisches gesunde Figur Institut OÜ, its directors, shareholders, employees, agents, board members, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for any indirect, special, incidental, punitive, exemplary, or consequential damages; any loss of use, data, transactions, or profits (whether direct or indirect), in all cases arising out of the use of Europäisches gesunde Figur Institut OÜ Service, irrespective of a legal basis, without regard to whether Europäisches gesunde Figur Institut OÜ has been warned of the possibility of those damages, and even if a remedy fails of its essential purpose; or aggregate liability for all claims relating to the Europäisches gesunde Figur Institut OÜ, above the amounts paid by you to Europäisches gesunde Figur Institut OÜ during the prior twelve months in question, to the extent permissible by applicable law.
20. None of the provisions of the Agreements shall exclude or limit Europäisches gesunde Figur Institut OÜ liability for fraud, fraudulent misrepresentation, death or any damage to health caused by negligence committed by Europäisches gesunde Figur Institut OÜ, and, if required by applicable law, gross negligence. Some aspects may not be valid in some jurisdictions if prohibited by applicable law.
21. To the maximum extent permitted by provisions of law in force, you agree to release Europäisches gesunde Figur Institut OÜ from and against any and all claims for damages, losses and expenses (including reasonable attorney's fees and expenses) arising out of: (1) your breach of the Agreement and (2) your violation of any provisions of applicable law or the rights of a third party.
